Makinde Approves Sharia Panel in Oyo State

Oyo State Governor Seyi Makinde has declared support for the operation of Sharia panel as an alternative dispute resolution method while upholding constitutional values and promoting unity.

Ibadan, Nigeria – In a recent Iftar program at the Government House in Agodi, the Oyo State Governor Seyi Makinde declared that he is not opposed to the use of Sharia panel in the state. The Oyo State Governor explained that anyone who finds this alternative dispute resolution method useful is free to approach the Sharia panel without any pressure to go to court.

Speaking at the Iftar, the Oyo State Governor noted that his administration’s focus is on ensuring that all actions follow the dictates of the Constitution. He highlighted that the Sharia panel could help resolve disagreements in a manner similar to how families settle disputes without legal battles.

The event, held at the frontage of the Presidential Lodge in Ibadan, brought together community leaders, religious figures, and government officials. Makinde praised the peaceful coexistence of different communities in the state and emphasized that his decision supports religious harmony and unity.

In his remarks, the Oyo State Governor stressed that there is no intention to test the constitutionality of the Sharia court’s operation in Oyo State in court. Instead, he welcomed the panel as an additional mechanism to reduce the number of cases reaching the formal judicial system, ensuring that disputes are resolved amicably and efficiently.

A Sharia Panel is a religious court that operates based on Islamic legal principles derived from the Quran, Hadith (sayings and actions of Prophet Muhammad), and other sources of Islamic jurisprudence. These panels are primarily found in Muslim-majority countries and regions with significant Muslim populations. They play a critical role in settling disputes, particularly in matters related to family law, inheritance, and personal conduct.

Sharia Panels are composed of Islamic scholars and jurists who have a deep understanding of Islamic law (Sharia). The structure of these panels varies depending on the country or state in which they operate. In some places, they function as an alternative dispute resolution mechanism, while in others, they are fully integrated into the judicial system. In many countries, Sharia Panels handle cases such as marriage, divorce, child custody, inheritance, and financial disputes among Muslims. Their decisions are usually binding on the parties involved, provided they willingly submit to the panel’s authority. However, in some jurisdictions, particularly in non-Muslim-majority countries, these panels do not have legal enforcement power but serve as advisory or mediatory bodies.

Sharia Panel often oversee Islamic marriages and divorces. They ensure that marriage contracts comply with Islamic principles and help resolve marital disputes. These panels play a vital role in mediating family conflicts, including matters related to child custody and spousal obligations. Sharia-compliant inheritance laws differ significantly from secular legal systems. The panels assist in ensuring that wealth distribution among heirs follows Islamic principles. In many cases, Sharia Panels function as mediators, helping disputing parties reach amicable settlements in accordance with Islamic teachings. Beyond legal matters, these panels often provide spiritual and moral guidance to members of the Muslim community.

Despite their significance, Sharia Panels have been a subject of controversy in many parts of the world. Some of the main issues include gender inequality concerns, as critics argue that Sharia Panels often favor men in cases of divorce, child custody, and inheritance, which raises concerns about gender justice. In countries with secular judicial systems, Sharia Panels create a parallel legal framework that can sometimes conflict with national laws, leading to legal ambiguities. Since different schools of Islamic thought interpret Sharia differently, decisions can vary widely between panels, creating inconsistencies in rulings. In non-Muslim-majority countries, the authority of Sharia Panels is often challenged, and their decisions are not legally binding, reducing their effectiveness. Some rulings of Sharia Panels, especially those related to corporal punishment and certain restrictions on personal freedoms, have sparked human rights debates.

A Sharia Panel play a crucial role in resolving disputes within Muslim communities and ensuring that legal matters comply with Islamic teachings. However, their operation varies widely based on regional laws and cultural contexts. While they provide a valuable service in certain areas, their existence also raises concerns regarding legal consistency, gender rights, and human rights compliance. For effective integration, many legal experts advocate for reforms that balance Islamic legal principles with modern human rights standards to ensure fairness and justice for all individuals under their jurisdiction.
