Supreme Court Ruling: Opposition Coalition Commends Fubara’s Submission to Authority on Rivers LGA Elections

The opposition coalition praises Governor Siminalayi Fubara for complying with the Supreme Court’s annulment of Rivers State’s LGA elections, appointing administrators pending new polls, and demonstrating democratic values amid political tensions.

In a significant political development, the opposition lawmakers’ coalition has lauded Rivers State Governor, Sir Siminalayi Fubara, for his prompt compliance with the Supreme Court’s recent judgment nullifying the October 5, 2024, Local Government Area (LGA) elections. The coalition highlighted Governor Fubara’s decision to appoint Heads of Local Government Administration (HLGAs) to oversee the 23 councils pending the conduct of fresh elections, interpreting this move as a testament to his commitment to democratic principles and the rule of law.

On February 28, 2025, the Supreme Court declared the Rivers State LGA elections held on October 5, 2024, as null and void. The five-member panel, led by Justice Jamilu Tukur, cited substantial non-compliance with the Electoral Act by the Rivers State Independent Electoral Commission (RSIEC) as the basis for the annulment. This landmark decision underscored the judiciary’s role in ensuring adherence to democratic processes and legal standards.

In response to the Supreme Court’s ruling, Governor Fubara directed all outgoing local government chairpersons to hand over administrative responsibilities to the HLGAs by Monday, March 3, 2025. This directive aims to maintain administrative continuity and uphold constitutional governance while preparations for new elections are underway. Governor Fubara emphasized his administration’s dedication to the rule of law, stating, “Although we disagree with the judgments, we are bound to obey the orders made therein as a law-abiding government.”

The opposition lawmakers’ coalition expressed their approval of Governor Fubara’s actions, acknowledging his respect for judicial authority and democratic norms. In a statement released by the coalition, they noted that despite provocations from factions loyal to former Governor Nyesom Wike, Governor Fubara has demonstrated a steadfast commitment to the principles of democracy. The coalition stated, “Fubara has shown he is a democrat despite pro-Wike group’s provocative rascality.”

The coalition also addressed the issue of the 27 lawmakers who defected from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC) in 2023. They asserted that these lawmakers remain “constitutionally sacked” until the Court of Appeal and the Supreme Court deliver judgments on the legality of their defection. The coalition emphasized that, pending these decisions, the seats of the defected lawmakers remain vacant, reinforcing the sanctity of electoral mandates and party allegiance.

The opposition coalition announced plans to address the nation formally after obtaining the Certified True Copy (CTC) of the Supreme Court’s judgment. This forthcoming address aims to clarify their stance on other contentious issues within the state’s political landscape and outline their strategies for ensuring adherence to constitutional provisions. The coalition’s spokesperson, Ikenga Imo Ugochinyere, urged residents to remain calm, assuring them of the opposition’s commitment to pursuing legal and peaceful resolutions to uphold constitutional order.

The Supreme Court’s annulment of the LGA elections and Governor Fubara’s compliance have several significant implications for Rivers State.
