The Supreme Court of Nigeria has set aside a ruling of the Court of Appeal in the ongoing leadership dispute within the African Democratic Congress (ADC), restoring the leadership of David Mark on a temporary basis.
In its decision delivered on Thursday, the apex court held that the Court of Appeal’s directive asking the party to maintain the Anti-Belum leadership structure was unnecessary and therefore invalid.
The ruling effectively reinstates David Mark’s leadership of the party, pending the final determination of the substantive suit.
The Supreme Court further ordered that the matter be returned to the High Court for a conclusive hearing and judgment on the leadership tussle.
By implication, the Independent National Electoral Commission (INEC) is expected to re-list the David Mark-led leadership of the ADC in its official records pending the outcome of the High Court proceedings.
The judgment marks a significant turn in the ADC crisis, temporarily resetting the party’s leadership structure while the legal battle continues.
